Terms & Conditions

Your use of istoreworld.com (the “Site”) and any content included therein, operated by Boutique iStore Canada Inc. and its affiliates (“iStore”), is conditional on your acceptance, without modification, of the following terms and conditions regarding the use of the Site and the purchase of goods and services through the Site (the “Terms & Conditions”). Each time you use the Site you signify your acceptance of the Terms & Conditions.

iStore may, at its sole discretion and for any reason, modify, supplement or amend the Terms & Conditions without any notice or liability to you or any other person, by posting revised Terms & Conditions on the Site. Your continued use of the Site signifies your acceptance of such revised Terms & Conditions.

Territorial Limitation

You may use the Site only if you are a resident of Canada or the United States, have reached the age of majority where you live and you can form legally binding contracts under applicable law. You may not use the Site if you live in a jurisdiction where access to or use of the Site may be illegal or prohibited.

Ownership and Permitted Use Of The Site

The Site is made available to you for your lawful, personal use only. Using the Site for any other purpose or in any other manner is strictly prohibited. Neither the Site nor its content may be, in whole or in part, copied, reproduced, republished, uploaded, posted, transmitted or distributed, except that you may download, display and print the content presented on the Site for your personal, non-commercial use only. Unauthorized use of the Site or the content contained on the Site may violate applicable copyright, trademark or other intellectual property laws or other laws. Your use of the Site does not transfer to you any ownership or other rights in the Site or its content. You must retain and not alter all copyright and trademark notices, including any other proprietary notices on the Site. The Site, and all content therein, is not intended for use by children under the age of 13. Use of the Site is void where prohibited by applicable law. iStore reserves the right, in its sole discretion and in addition to any other rights or remedies it has, to terminate or restrict your access to any components of the Site.

iStore’s privacy practices regarding any Personal Information iStore collects are explained in the Privacy Policy, the terms of which are hereby incorporated herein by reference.

User Name and Password

Certain areas and features of the Site are accessible only to users who have been issued a login name and password by iStore. All codes remain the property of iStore and may be cancelled or suspended at any time by iStore without any notice or liability. You are solely responsible and liable for any use and misuse of your login name and password and for all activities that occur under your login name and password. In the event that the confidentiality of your login name and password are compromised in any manner, you must notify iStore immediately. iStore reserves the right to take any action, as it deems necessary or reasonable, to ensure the security of the Site and your account, including without limitation, terminating your account, changing your password or requesting information to authorize transactions on your account. In no event will iStore be held liable to you for any liabilities or damages resulting from or arising out of the misuse of your codes.

Product Information and Availability

iStore attempts to be as accurate as possible. However, iStore does not warrant that descriptions of products or services or other content of the Site are accurate, complete, reliable, current, or error-free. If a product or service offered on the Site is not as described, your sole remedy is to return it in unused condition. The availability of certain products or services may be limited or may not be available for immediate delivery. iStore may revise or cease to make available any products or services at any time without prior notice.

Orders and Pricing

All prices and orders of products or services are quoted and shall be processed in Canadian or US dollars and do not include shipping and handling charges and applicable taxes. Separate charges for shipping and handling and taxes will be shown on the order confirmation for each order, as applicable.

Before submitting an order for the purchase of products or services you will be shown an order confirmation screen (the “Order Confirmation”) describing, among other things, the products or services to be ordered, the purchase price and any applicable charges for shipping and taxes. When you submit your order (by pressing the “Place Order” button), such order will constitute an offer from you to the iStore to purchase the products or services described in the Order Confirmation, for the price and subject to the other charges, terms and conditions set out in the Order Confirmation. Orders are not binding on iStore until acceptance of your order by iStore is evidenced by return e-mail from iStore indicating that your order has been accepted. A separate shipping confirmation e-mail will be sent once your order has shipped.

We reserve the right at any time to reject, correct cancel or terminate any order for any reason whatsoever. If the price of any product or service you ordered was incorrectly displayed on our Site, we will provide you with an opportunity to place an order at the correct price.

The total price of your order will be charged to your method of payment when our shipping confirmation e-mail is sent to your email address.

Cancellation

If you wish to cancel an order, you may request a cancellation by logging into your account and cancelling your order or by calling 1-888-995-5994. However, we may not receive and process your cancellation request before we accept and ship your order, in which case your cancellation request may not be effective. If for any reason you are not completely satisfied with a product you have purchased, you may return it according to our Returns policy described below.

Payment Terms

Payment can be made securely online by Visa, MasterCard, AMEX or via Pay Pal. The credit card being used must be yours. All credit cards are subject to validation checks and authorization by the card issuer. iStore will not be liable for any delay or non-delivery of your order if the issuer of your credit card refuses to authorize payment. iStore will cancel your order in the event that your card authorization and validation is declined.

Shipping

If iStore has your products in stock, we will email you a shipping notice confirming that the items have shipped and are en-route to you. In-stock orders normally ship within two (2) business days of placing your order. iStore does not currently deliver to P.O. boxes, a few limited geographic areas within Canada and the United States and outside of Canada and the United States.

Returns

Unopened items in original packaging returned within fourteen (14) days of receipt of the Product will receive a refund to the original method of payment. Items that are opened, damaged and/or not in resalable condition may not be eligible for a refund. To return a product please follow the instructions for Returns on our Site.

THE LAWS OF CERTAIN JURISDICTIONS, INCLUDING QUEBEC'S CONSUMER PROTECTION ACT, DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR CONDITIONS OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE BELOW DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MIGHT NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS. ALL SERVICES, INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. If you decide to access other websites, you do so at your own risk.

Relationship

The relationship between iStore and you will be that of independent contractors, and neither of us nor any of our respective officers, agents or employees will be held or construed to be partners, joint ventures, fiduciaries, employees or agents of the other as a result of these Terms and Conditions or your use of the Site.

General

If any provision of this Agreement is held to be invalid or unenforceable for any reason, then the provision will be deemed to be severed from this Agreement and the remaining provisions will continue in full force and effect. This Agreement enures to the benefit of and is binding upon each of iStore and its successors, assigns and related persons, and you and your heirs, executors, administrators, successors, permitted assigns and personal representatives. You may not assign this Agreement or the rights and obligations under this Agreement. iStore may assign this Agreement and its rights and obligations under this Agreement without your consent. No consent or waiver by any party to or of any breach or default by any other party in its performance of its obligations under this Agreement will be: (a) deemed or construed to be a consent to or waiver of a continuing breach or default or any other breach or default of those or any other obligations of that party; or (b) effective unless in writing and signed by all parties.

Any rights not expressly granted by this Agreement are reserved to iStore.

Entire Agreement

The Terms and Conditions constitute the entire agreement between us relating to the subject matter hereof, and supersede any prior understandings or agreements (whether electronic, oral or written) regarding the subject matter hereof, and may not be amended or modified except by iStore as set forth above.

Governing Law

The Terms and Conditions and their performance shall be governed by the laws of the Province of Quebec, Canada. You consent and submit to the exclusive jurisdiction of the courts located in the City of Montreal, in the Province of Quebec, Canada, in all disputes arising out of or relating to the use of this Site and the Terms and Conditions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to the Terms and Conditions.

Language

The parties have expressly requested and required that this Agreement and all other related documents be drawn up in the English language. Les parties conviennent et exigent expressément que ce Contrat et tous les documents qui s'y rapportent soient rédigés en anglais.
